Background Checks and BCA Records

The Bureau of Criminal Apprehension (BCA) is the statewide source for comprehensive criminal history background checks in Minnesota. The BCA keeps records from courts and law enforcement agencies across every county, including Stearns County and the Saint Cloud area. If you need a certified criminal history for employment, licensing, or legal purposes, request it through the BCA portal at dps.mn.gov.

Under Minnesota Statute 13.87, conviction records held by the BCA are public data for 15 years following discharge of sentence. Arrest-only records are not public through the BCA. For general court record searches, MCRO gives access to case-level conviction data without a formal BCA request.

The DOC Offender Locator at coms.doc.state.mn.us/publicviewer lets you search for current and past Department of Corrections offenders statewide. For anyone convicted of a felony in Stearns County and sentenced to prison, you can check their current facility and release status here for free.

Expungement of Saint Cloud Criminal Records

Minnesota allows people to seek expungement of certain criminal records under Minnesota Statute 609A.02. Expungement seals the record from public view. Saint Cloud residents whose cases were handled in Stearns County would file an expungement petition at the Stearns County District Court. Waiting periods depend on the offense type: two years for misdemeanors, four years for gross misdemeanors, and five years for certain felonies.

The petition process involves serving copies on multiple agencies, each of which may object. The judge reviews all responses before making a decision. Even if expungement is granted, the record is not destroyed. Law enforcement can still access sealed records in limited situations. For most public purposes, though, the record becomes invisible to background checks and public searches.

The Minnesota Judicial Branch website at mncourts.gov has expungement petition forms and instructions. Legal aid organizations serving the Saint Cloud area can also help you figure out if you qualify and guide you through the filing process.
